ENEXT
1. Purpose and Scope

This Policy & Procedures document governs the relationship between ENEXT, its customers, vendors, distributors/direct sellers and other participants using the ENEXT platform.

ENEXT shall conduct its business in accordance with applicable laws of India, including the Consumer Protection Act, 2019, Consumer Protection (Direct Selling) Rules, 2021 and applicable amendments, Consumer Protection (E-Commerce) Rules, 2020, applicable tax laws, Legal Metrology requirements, applicable product-specific laws and other regulations applicable to the products and services offered by ENEXT.

Where any applicable law changes, the law shall prevail over any conflicting provision of this policy.

2. Customer Policy
  1. Customers may purchase products through the ENEXT platform at the prices displayed at the time of purchase.
  2. Customers must provide accurate name, mobile number, email, billing information and shipping address.
  3. Customers are responsible for reviewing their details before confirming an order.
  4. Once an order is confirmed, changes to the shipping address may not be possible if processing or dispatch has commenced.
  5. Customers shall receive an order confirmation and applicable invoice/transaction information.
  6. Product information, price, taxes, delivery charges, warranty and applicable terms shall be displayed before purchase.
  7. Customers shall not be required to purchase products merely to obtain consumer rights or services.
  8. Customers shall not be promised guaranteed income, guaranteed returns or guaranteed business success.
  9. Product complaints, damaged-product claims, incorrect deliveries and refund requests must be submitted through the prescribed ENEXT support process.
  10. ENEXT shall process eligible complaints and refunds in accordance with applicable law and this policy.
3. Vendor Policy
  1. Every vendor must complete the applicable onboarding and verification process before listing products.
  2. Vendors must provide accurate business, tax, bank, product, brand and regulatory information.
  3. Vendors shall possess all licences, registrations, approvals, certifications and permissions legally required for their products.
  4. Vendors are responsible for the legality, authenticity, quality, safety, labelling, packaging, warranty and regulatory compliance of their products.
  5. Vendors shall not list counterfeit, prohibited, unsafe, expired, misleading or unlawfully marketed products.
  6. Product descriptions, images, prices, MRP, taxes, HSN/classification, country of origin, warranty and other mandatory information must be accurate.
  7. Vendors must fulfil orders within the committed processing and delivery timelines.
  8. Vendors must cooperate with customer complaints, returns, replacements, refunds, recalls and regulatory investigations.
  9. ENEXT may suspend, restrict or remove a vendor/product where there is suspected fraud, regulatory non-compliance, customer harm or violation of this policy.
  10. Vendor payments may be withheld or adjusted where permitted under the vendor agreement, including for refunds, chargebacks, penalties, taxes or unresolved disputes.
4. Distributor / Direct Seller Policy
  1. A distributor/direct seller is an independent participant and is not an employee, partner, franchisee or legal agent of ENEXT unless expressly stated in a written agreement.
  2. Every distributor/direct seller must complete registration/KYC and accept the applicable Distributor Agreement and Code of Conduct.
  3. A distributor/direct seller must truthfully identify themselves and ENEXT when approaching a prospective customer.
  4. All product and business information must be accurate, complete and capable of verification.
  5. No distributor/direct seller may make false, misleading, exaggerated or unsupported claims regarding products, income, commissions, rankings, lifestyle, earnings or business opportunities.
  6. No distributor/direct seller may guarantee income, investment returns, employment, financial freedom or business success.
  7. Distributors/direct sellers shall not engage in harassment, spam, impersonation, deceptive advertising or unauthorised use of ENEXT’s trademarks.
  8. Customer orders must be genuine and must not be created merely to generate artificial sales, points, UVs, rankings or commissions.
  9. Distributors/direct sellers shall comply with all applicable ENEXT policies and applicable laws.
  10. ENEXT may suspend or terminate a distributor/direct seller for fraud, manipulation, false representation, prohibited recruitment practices, policy violations or legal non-compliance.
The Direct Selling Rules require direct sellers to have a written contract and impose duties concerning identification, truthful information, pricing, returns/refunds and order information. (Press Information Bureau)
5. Network Marketing / Compensation Policy
  1. ENEXT operates a product-based direct-selling/network-marketing model only to the extent permitted by applicable law.
  2. Compensation shall be generated only from legitimate product/service transactions and activities permitted under the company’s compensation plan.
  3. Recruitment by itself shall not create an entitlement to commission.
  4. No participant shall receive compensation merely for paying a registration fee, enrolling another person or introducing another participant.
  5. No participant may represent ENEXT as an investment, deposit, guaranteed-return or get-rich-quick scheme.
  6. Pyramid schemes and money-circulation schemes are strictly prohibited.
  7. Participants shall not purchase products solely for the purpose of obtaining compensation where such purchasing is inconsistent with the applicable rules or compensation plan.
  8. ENEXT may audit transactions, genealogy, sales volume, UVs, commissions, wallets and other business records to prevent manipulation.
  9. Artificial transactions, self-purchases, fictitious customers, circular transactions, duplicate accounts, wallet manipulation and other fraudulent activity are prohibited.
  10. ENEXT may reverse, hold or recover commissions generated through cancelled, refunded, fraudulent or otherwise invalid transactions, subject to applicable law and contractual terms.
Indian law specifically prohibits direct-selling entities and direct sellers from promoting or participating in pyramid schemes or money-circulation schemes. (Press Information Bureau)
6. UV / Points / Business Volume
  1. UV, points, business volume or similar measurements are internal calculation mechanisms of ENEXT.
  2. UV shall not automatically represent cash, investment, deposit or guaranteed monetary value.
  3. UV/points shall be generated only from eligible transactions according to the compensation plan.
  4. Cancelled, returned, refunded, fraudulent or otherwise ineligible transactions may result in reversal of associated UV/points and commissions.
  5. ENEXT may correct technical, accounting or calculation errors after verification.
  6. No distributor may manipulate transactions to artificially increase UV, rankings or commissions.
7. Commission and Payout Policy
  1. Commissions are calculated according to the compensation plan applicable to the relevant transaction period.
  2. A commission becomes payable only after the underlying transaction satisfies the applicable eligibility requirements.
  3. Refunds, cancellations, chargebacks, invalid transactions, compliance holds and statutory deductions may affect commission eligibility.
  4. ENEXT may conduct verification before releasing commissions.
  5. Payments shall be made through approved banking/payment channels.
  6. The participant is responsible for maintaining accurate bank and KYC information.
  7. ENEXT shall make statutory deductions wherever required by applicable tax law.
8. TDS / TDA / Statutory Deductions
  1. Any reference on the ENEXT platform to TDS, TDA or statutory deduction shall mean a deduction required or permitted under applicable law or under the company’s documented payout mechanism.
  2. Applicable tax shall be deducted at the rate and in the manner prescribed by the relevant tax law and the participant’s applicable status.
  3. Participants must provide valid PAN and other tax/KYC information required for payout processing.
  4. If PAN, KYC or banking information is missing, invalid or incorrect, ENEXT may hold or process payment as permitted by law.
  5. Statutory deductions do not represent a company penalty.
  6. The participant remains responsible for their own income-tax and other personal tax obligations.
  7. ENEXT may issue applicable tax certificates/statements where legally required.
9. Redemption / Fourth Check Policy
  1. Redemption of any wallet balance, eligible commission, incentive, reward or “fourth check” shall be governed by the applicable ENEXT compensation/redemption plan.
  2. Redemption shall be available only against amounts that are legally and contractually eligible for withdrawal.
  3. The participant must satisfy applicable KYC, tax, compliance, transaction and minimum-redemption requirements.
  4. Amounts associated with cancelled, refunded, disputed or fraudulent transactions may be withheld or reversed.
  5. Statutory deductions shall be applied wherever required.
  6. ENEXT may verify the underlying transactions before approving redemption.
  7. No redemption shall be treated as a guaranteed return on money paid to ENEXT.
  8. Detailed minimum amount, processing period and eligibility conditions shall be displayed in the applicable compensation plan or participant dashboard.
10. Free Registration / Trial / Promotional Registration
  1. Where ENEXT provides free registration, such registration shall not by itself constitute a purchase, investment or guarantee of commission.
  2. Promotional registration shall not create an automatic right to commission.
  3. Only eligible genuine transactions shall be considered for business volume, UV and compensation.
  4. Promotional registrations, wallets, counters or temporary entries may be closed, reset or removed according to the applicable promotion terms.
  5. Any promotional activity shall be conducted in accordance with applicable law.
11. Refund and Cancellation Policy
  1. Customers may request cancellation, return or refund where permitted under applicable law and the product-specific return policy.
  2. Products must generally be returned in the condition required by the applicable return policy, subject to applicable consumer rights.
  3. Refund eligibility may depend on the product category, condition, delivery status, warranty terms and applicable law.
  4. Products damaged after delivery due to customer misuse may be excluded where legally permissible.
  5. Refunds shall normally be processed through the original or an approved payment method.
  6. Where a transaction is refunded, associated commissions, UV, points or incentives may be reversed as permitted under the compensation plan.
  7. Refunds shall not be denied merely because a customer has exercised a statutory consumer right.
  8. Product-specific return/refund terms displayed at the time of purchase shall also apply, provided they do not restrict rights available under applicable law.
12. Complaint and Grievance Redressal
  1. Customers, vendors and distributors may raise complaints through ENEXT’s designated grievance channel.
  2. Complaints should contain the order/registration number, relevant transaction details and supporting documents where applicable.
  3. ENEXT shall acknowledge and process complaints through its prescribed grievance mechanism.
  4. Complaints involving product quality, delivery, refund, payment, commissions or distributor conduct shall be investigated according to their nature.
  5. ENEXT shall maintain appropriate records of complaints and their resolution.
  6. The company shall provide applicable escalation mechanisms and grievance-officer details on the website.
The Government has specifically stated that direct-selling entities are expected to participate in the National Consumer Helpline convergence process to facilitate consumer grievance redressal. (Consumer Affairs)
13. Prohibited Activities

The following activities are strictly prohibited:

  • Pyramid schemes or money-circulation schemes.
  • Guaranteed income or guaranteed returns.
  • False or misleading product claims.
  • False or misleading income claims.
  • Recruitment-only compensation.
  • Fake orders or fictitious customers.
  • Self-purchasing solely to manipulate qualifications.
  • Multiple/duplicate accounts created for manipulation.
  • Manipulation of UV, points, genealogy, wallets or commissions.
  • Unauthorised collection of money from customers or distributors.
  • Selling products outside the authorised process where prohibited.
  • Counterfeit or unauthorised products.
  • Misuse of ENEXT’s name, logo, trademarks or intellectual property.
  • Harassment, threats, abusive conduct or fraudulent representations.
  • Unauthorised medical, health, nutritional or therapeutic claims.
  • Any activity prohibited under applicable Indian law.
14. KYC and Data Protection
  1. ENEXT may collect identity, contact, banking, tax and transaction information necessary for registration, order fulfilment, payment, compliance and fraud prevention.
  2. Participants and customers must provide accurate information.
  3. ENEXT shall process personal information in accordance with applicable data-protection and privacy laws and its Privacy Policy.
  4. Users must not access, disclose or misuse another person’s account or personal information.
15. Account Suspension and Termination

ENEXT may suspend, restrict or terminate an account where there is:

  • Fraud or suspected fraud;
  • False information;
  • Regulatory or legal violation;
  • Manipulation of transactions, UV, commissions or wallets;
  • Violation of the Distributor/Vendor Agreement;
  • Prohibited marketing or product claims;
  • Unauthorised use of ENEXT systems or intellectual property;
  • Conduct causing material harm to customers, vendors, distributors or ENEXT.

Where appropriate and legally required, the concerned person may be provided an opportunity to respond or rectify the violation.

16. Product Compliance

Every product sold through ENEXT must comply with the laws and regulatory requirements applicable to that product category.

Depending on the product, this may include requirements relating to GST, Legal Metrology, BIS, FSSAI, Drugs/Cosmetics regulations, consumer protection, intellectual property, packaging, labelling, advertising and other applicable laws.

The required licence or approval shall be obtained by the legally responsible party, and ENEXT may require documentary evidence before permitting a product to be listed or sold.

17. Advertising and Social-Media Policy

All advertisements, social-media posts, videos, presentations and promotional material relating to ENEXT must:

  1. Be truthful and non-misleading.
  2. Use only authorised claims and materials.
  3. Not guarantee income.
  4. Not make unsupported product/health claims.
  5. Not misrepresent the compensation plan.
  6. Not portray ENEXT as an investment or guaranteed-return opportunity.
  7. Not falsely represent lifestyle, earnings or business results as typical outcomes.
  8. Not impersonate ENEXT or its authorised representatives.
18. Records and Audit

ENEXT shall maintain appropriate records relating to orders, customers, vendors, direct sellers, transactions, commissions, complaints, refunds and other records required by applicable law.

ENEXT may conduct internal audits and compliance reviews and may require supporting documents from customers, vendors or distributors where reasonably necessary.

19. Amendments

ENEXT may amend this Policy & Procedures document from time to time to reflect changes in law, regulations, technology, products, business processes or the compensation plan.

The latest version published on the official ENEXT website shall apply prospectively, subject to applicable law and contractual rights.

20. Governing Law

This Policy & Procedures document shall be governed by the laws of India.

Nothing in this policy shall exclude or restrict any mandatory statutory right available to a consumer, vendor, distributor or other person under applicable law.

Any dispute shall be handled through the applicable grievance, dispute-resolution and legal mechanisms prescribed by law and the relevant agreement.

21. Acceptance

By registering with ENEXT, purchasing products, becoming a vendor, becoming a distributor/direct seller, or otherwise using the ENEXT platform, the person acknowledges that they have read and agreed to the applicable terms, policies, agreements and procedures, subject always to their rights under applicable law.
